Competition Terms and Conditions

1. Instructions on how to enter form part of these conditions of entry and participation in this competition is deemed acceptance of these conditions of entry.
2. The Promoter is Sea Change Resort Management Pty Ltd ABN 81 105 469 467 T/A Castaway Cove of 11/528 David Low Way, Marcus Beach, Queensland, 4573.
3. Employees and their immediate families of the Promoters, their associated agencies and companies associated with this competition are ineligible to enter.
4. Entry is open to any resident of Australia over 18 years of age.
5. Only one entry per email address is allowed.
6. By entering this competition participants agree to provide their full name and email address and subscribe to the Promoter’s monthly e-newsletter and remain subscribed at the time of the competition draw, and also remain subscribed at the time of the competition redraw if a redraw occurs in accordance with these terms and conditions of entry.
7. There will be one prize draw every three months until terminated by the Promoter.  Each competition starts at the beginning of each calendar quarter (ie 1st Jan, 1st Apr, 1st Jul, 1st Oct) and concludes at the end of each calendar quarter (ie 31 Mar, 30 Jun, 30 Sep, 31 Dec).
8. The prize is a 3 night beachside holiday in a 1 Bedroom Apartment for 2 adults at Castaway Cove Resort Noosa, and includes a bottle of sparkling wine and hand-crafted chocolates on arrival.  The Apartment does not have ocean views or spa.
9. Accommodation is available in low season only (as per dates published on the Promoter’s website) and must be taken as 3 consecutive nights midweek, Sunday to Thursday, and is subject to availability.
10. The total prize value of $470 is the normal retail value as advertised by the Promoter on its website and is correct at the time of printing.
11. The prize is for accommodation only and does not include transport to and from the Resort, meals, or other incidental expenses.
12. Any change in the value of the prizes between the publishing date and the date prizes are claimed is not the responsibility of the Promoter.
13. The competition winner will be determined by random draw.   The first valid entry drawn and deemed correct will win the prize.  The winner’s name will be published on-line on the first day of each calendar quarter.
14. After the winner has claimed his/her prize, a voucher will be mailed to the winner which must be redeemed and accommodation booked and taken within 6 months of the date displayed on the prize voucher. If the prize winner fails to comply with these conditions for whatever reason, the winner will forfeit the prize in whole.
15. If the prize is unclaimed 7 days after the draw, a redraw will occur and the winner notified and advertised as described above.
16. The competition prize is non-transferable and not exchangeable for cash. Only one prize, as chosen by the first drawn correct entry, shall be awarded.  The winner must take the prize as given, however the winner may upgrade (to a different room type, to include additional persons, or to extend their stay) for an additional charge - being the difference between the prize value and the normal rates applicable at the time for the upgrade.  Any additional charges must be settled prior to departure.
17. If any prize (or part of any prize) is unavailable, the Promoter, in its sole discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of at least equal value and/or specification.
18. The Promoters’ decision as the judge, on any aspect of the competition is final and binding and no correspondence will be entered into.
19. The Promoter takes no responsibility for incorrect or inaccurate information supplied via internet or by mail. It is the responsibility of entrants to provide clear, correct and accurate contact details.
20. The Promoter reserves the right to request the winner to provide proof of identity, age and/or residency at the nominated prize delivery address in order to claim the prize. Identification considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute or cash will be offered in lieu.
21. The Promoter shall not be liable for prizes or for prizes which are not redeemed by the winner.
22. The Promoter reserves the right in its sole discretion to disqualify any entrant who appears to have tampered with the entry process, who participates in a manner not in accordance with these terms and conditions of entry or who has, in the opinion of the promoter, engaged in conduct which is or may be fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the Promoter.
23. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness or integrity or proper conduct of this competition the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition.
24. The winners release the Promoter from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the winner as a result of any loss or damage to any physical property of the winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoters or the prize.
25. The Promoter will not use or disclose an entrant’s personal information for marketing or consumer research purposes other than as specified in clause 6.  The Castaway Cove privacy statement may be viewed at http://www.castawaycove.com.au/privacy-policy.htm.
